GENERAL TERMS AND CONDITIONS OF USE FOR THE “DULCE HALLOWEEN” PLATFORM AND MOBILE APPLICATION

I. PREAMBLE AND BINDING ACCEPTANCE

This document sets forth the General Terms and Conditions of Use (hereinafter, the “Terms”) governing access to, browsing of, and use of the “Dulce Halloween” digital platform and mobile application, including the website dulcehalloween.com and the official mobile applications (hereinafter, the “Platform” or the “Application”), owned and operated by ADAN ESAU LUNA CONTRERAS (hereinafter, the “Provider”).

These Terms constitute a legally binding agreement between you (hereinafter, the “User”) and the Provider. By browsing or interacting with the website, downloading the Application from official app stores (Apple App Store for iOS devices and Google Play Store for Android devices), installing, accessing, registering, or using its features in any way, the User unequivocally consents and agrees fully and unreservedly to each and every provision contained herein.

Furthermore, the User acknowledges that the use of the Platform and the Application is inextricably linked to acceptance of our Comprehensive Privacy Policy, which is understood as an integral and inseparable part of these Terms and may be consulted at any time within the Application and on our official website (dulcehalloween.com/privacy-policy/).

Whenever these Terms, Official Contest Rules, or the Privacy Policy are updated, the Application and Platform will require the User to review and re-accept them before logging in. Without such acceptance, the User cannot access features requiring an account.

If the User does not agree with these Terms and/or the Privacy Policy in their entirety, the User must immediately refrain from using the website and permanently uninstall the Application.

II. PURPOSE AND SERVICE DESCRIPTION

Dulce Halloween is a collaborative digital community platform and interactive Halloween map whose primary purpose is to allow Users to voluntarily register the location of their homes, businesses, and meeting points to indicate their participation in handing out candy and treats during the Halloween season in Mexico and the United States of America. The Platform allows families and other Users to view these participating locations in real time to plan safe trick-or-treat walking routes and locate seasonal points of interest.

Additionally, the Platform and Application host the official seasonal community contests, including the Decorated Houses Contest, the Costumes Contest, and the Pet Costumes Contest, participation in which is always free, voluntary, and open, subject to specific contest rules detailed in these Terms.

The service is provided on an “as is” and “as available” basis, and availability may vary based on technical factors, network conditions, and geographic coverage.

III. BUSINESS MODEL AND MONETIZATION

The User acknowledges and agrees that Dulce Halloween operates under a sustainable business model that includes:

  • (a) Free Ad-Supported Access: Core access to the interactive map, search, and navigation features is free of charge for the User. This model is financed through ethical third-party advertising (such as banner ads, interstitials, or video ads), managed through reputable advertising networks. Data processing for this purpose is detailed in our Privacy Policy.
  • (b) In-App Purchases (IAP): The Provider reserves the right to offer optional digital content, cosmetic items, collectible map markers (such as seasonal spooky villain icons), advanced features, or ad removal in exchange for a one-time or recurring fee. All transactions are securely processed through official billing platforms designated by Apple (App Store) and Google (Play Store) and are subject to their respective terms and conditions.
  • (c) Complete Independence of Contests: No in-app purchase or payment of any kind is required to enter, participate, or vote in any official contest, nor does any purchase grant any advantage, preference, or privilege in voting results or deliberations.

IV. USER ACCOUNTS, ELIGIBILITY, AND CHILD PROTECTION (COPPA COMPLIANCE)

To access certain features (such as registering a home, submitting contest entries, or casting votes), the User must create an account. The User agrees to provide accurate, current, and complete information during registration and keep it duly updated. The User is solely and exclusively responsible for maintaining credentials confidentiality and for all activity occurring under the account, and must promptly notify the Provider of any unauthorized use or security compromise at [email protected] or [email protected].

Independent use of the Platform is intended for individuals of legal majority (18 years or older). If a minor interacts with the Application or map, it is strictly presumed and required that they do so under the direct supervision, express consent, and full legal responsibility of their parents or legal guardians, who accept these Terms on the minor’s behalf.

Enhanced Protection of Minors’ Likeness and Images: Photographs or videos depicting minors may only be uploaded and submitted by their parent or legal guardian from their own verified account. Uploading images of minors without verified parental authority or legal custody is strictly prohibited.

V. RULES OF CONDUCT AND ACCEPTABLE USE

The User agrees to use the Platform in a lawful, civil, and respectful manner in strict compliance with these Terms and applicable laws. Prohibited conduct includes, without limitation:

  • Registering false or misleading information, third-party home addresses without the owner’s or resident’s express written permission, or locations that do not represent genuine trick-or-treat stops.
  • Uploading, posting, or transmitting any content that is unlawful, threatening, defamatory, obscene, discriminatory, inciting violence, infringing privacy, or violating third-party intellectual property rights.
  • Contest Fraud and Artificial Intelligence: Uploading images copied from the internet, belonging to third parties, or substantially generated or altered using Artificial Intelligence (AI) tools to fabricate contest submissions.
  • Vote Manipulation: Tampering with, artificially inflating, or manipulating community contest voting through fake accounts, multi-accounting, bot farms, emulators, paid voting schemes, or automated exchange rings.
  • Harassing, stalking, intimidating, threatening, impersonating any person or entity, or disrupting the community experience.
  • Using the Platform for unauthorized commercial solicitations, spam, unsolicited advertising, or automated mass data extraction (scraping, crawling, or harvesting home addresses).
  • Attempting to decompile, reverse-engineer, disassemble, or breach the security of the Platform, mobile apps, or APIs.

VI. USER CONTENT AND DISTRIBUTION LICENSE

The User is solely and exclusively responsible for all images, videos, texts, house names, and other materials submitted or shared on the Platform (“User Content”). By submitting User Content, you represent and warrant that you are the sole creator and rights holder, or have obtained all necessary documented consents and waivers from every individual depicted.

By uploading User Content, you grant the Provider a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, reproduce, distribute, adapt, publicly display, and broadcast such Content for the sole purpose of operating, promoting, and highlighting the Platform and official contests, including publication across official Dulce Halloween social media channels:

The Provider utilizes automated moderation tools and human editorial oversight, reserving the absolute right to remove, suspend, or delete without prior notice any Content or account that violates these Terms, contest rules, or applicable laws.

VII. GENERAL OFFICIAL CONTEST RULES 2026

Dulce Halloween organizes voluntary, free-to-enter community contests celebrating family creativity. Contests are governed by the following rules and official schedule:

  1. Official Categories:
    • (a) Decorated Houses Contest: Open to residential homes decorated and registered on the official map. Submission and voting period: from season opening in the application until November 5, 2026 at 11:59 PM (Central Time).
    • (b) Costumes Contest: Photographs of individuals in festive Halloween attire. Submissions close October 30, 2026 at 11:59 PM; voting closes November 5, 2026 at 11:59 PM.
    • (c) Pet Costumes Contest: Photographs of household pets in Halloween costumes. Submissions close October 30, 2026 at 11:59 PM; voting closes November 5, 2026 at 11:59 PM.
  2. Binational Eligibility: Open to legal adults residing in the United Mexican States or the United States of America (USA). The Organizer and its immediate staff are not eligible to compete.
  3. Completely Free: No purchase, fee, or subscription is required to register, participate, or vote. In-app digital items or map badges do not provide votes or scoring advantages.
  4. Voting and Anti-Fraud Auditing: Winners are determined by legitimate community votes subject to anti-fraud algorithmic audits. The Organizer reserves the right to void irregular votes or disqualify entries using bots, fake accounts, or unoriginal imagery.
  5. Honorary Nature: Awards, digital 3D trophies, and titles are honorary and symbolic to foster community goodwill. Official results will be published no later than November 12, 2026 on the Platform and official social channels.
  6. Platform Disclaimer: Apple Inc. and Google LLC do not sponsor, endorse, certify, or administer Dulce Halloween contests in any way, and bear no legal liability or connection whatsoever with the operation of these events.

VIII. THIRD-PARTY ADVERTISING AND EXTERNAL LINKS

The Platform displays advertising spaces and links to third-party sites (including local sponsors, commercial venues, and map providers). The Provider assumes no responsibility regarding the accuracy, availability, quality, or privacy practices of these third parties. Any business dealings or transactions between the User and advertisers are solely at the User’s own risk.

IX. INTELLECTUAL AND INDUSTRIAL PROPERTY

All rights in the Platform, software, source code, algorithms, databases, visual designs, animations, trademarks, trade names, logos, and slogans of Dulce Halloween are the exclusive property of the Provider or its legitimate licensors. The User is granted a personal, limited, non-transferable, non-sublicensable, revocable license to access the website and use the mobile application solely for the personal, non-commercial purposes described herein.

X. DISCLAIMER OF WARRANTIES AND ON-STREET ROUTE LIABILITY

The Platform is provided “as is” and “as available”. The Provider does not warrant uninterrupted service and is not liable for data connection failures, mapping inaccuracies from third-party map providers, or inaccurate voluntary pin submissions by users.

Street Safety and Trick-or-Treat Liability Disclaimer: The User understands and accepts that trick-or-treating, walking neighborhood blocks, and visiting residential properties are outdoor public activities beyond the Provider’s control. The User assumes full and absolute responsibility for their personal safety and that of minors and companions in their care when visiting addresses shown on the map, releasing and holding harmless the Provider from any physical incident, accident, traffic incident, civil dispute, or neighborhood occurrence that may arise.

XI. INDEMNIFICATION

The User agrees to defend, indemnify, and hold harmless the Provider, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of: (a) improper use of the Platform; (b) breach of these Terms; (c) infringement of third-party rights; or (d) the falsity or illegality of Content uploaded by the User.

XII. SUSPENSION AND TERMINATION

The Provider reserves the right to temporarily or permanently suspend any User account, as well as remove registered pins or contest submissions, in the event of serious or repeated violations of these Terms or community guidelines, without right to compensation.

XIII. ELECTRONIC COMMUNICATIONS

The User agrees to receive operational service communications via push notifications, in-app notices, platform banners, or emails sent to their registered address. Such electronic communications satisfy any legal requirement that such communications be in writing.

XIV. GOVERNING LAW AND BINATIONAL JURISDICTION

These Terms are governed by and construed in accordance with the federal laws of the United Mexican States. For any dispute not resolved amicably, the parties submit to the exclusive jurisdiction of the competent courts of the City of Monterrey, State of Nuevo León, Mexico, expressly waiving any other jurisdiction that may correspond to them by reason of present or future domicile.

This provision applies without prejudice to non-waivable consumer protection rights granted to United States residents by applicable U.S. federal and state consumer protection legislation.

XV. GENERAL PROVISIONS

  • Severability: If any provision is deemed invalid or unenforceable, remaining provisions remain in full force and effect.
  • No Waiver: Failure to enforce any provision does not constitute a waiver of future rights.
  • Entire Agreement: These Terms, the Privacy Policy, and Official Contest Rules constitute the complete and final agreement between the User and Provider, superseding any prior communications or representations.
